Two wheeler recovery after theft

My two wheeler -Activa was stolen 3 weeks back and is now found. I am being told by police that in order to recover it back, I have to go through court processes. Its a old vehicle,was already in poor condition. Now the expenses to recover it is costing me more money than the actual cost even if it is sold presently. Is it OK if do not wish to get it back and leave the vehicle there, or do I have to recover it back in any case? please guide me.

To recover the vehicle you will have to file suprutnama under section 457 of CRPC it take same legal expenses , you simply go to concerned police station and write a latter to PI that you are unable to go court the PI has special power to released the vehicle but you have to keep all the relevant documents in relation to prove ownership

yes, you need to recover it back because it was your complaint to the police regarding the theft of your vehicle. you can not give the excuse that the vehicle id in bad condition or the recovery expenses are more than the present value of the vehicle. file an application of return of property in the concerned court.

We appreciate and understand your dilemma for claiming or not claiming the vehicle while considering the cost involved. You may simply make an application for release of recovered goods to the concerned magistrate court along with recovery certificate of concerned police station. You may also choose not to collect it, but it is pertinent that you procure and preserve a copy of recovery certificate from the police for your records.

It is correct that your vehicle will only be released after court order. If you have no money to rlease you may apply for Legal Aid office of Court there you will get free of cost Advocate. He will look after your vehicle to release with proper court order.
