Trespassing Criminal Case Delhi

Is it necessary to file a police complaint for a criminal treaspassing or one should directly report to the court. Please advice. Can we directly approach the court for any criminal case. Thanks Ajit 7982260556

There are two ways you can start any criminal proceedings. First is by way of police complaint by filing of FIR. In this way police investigates the case gathers evidence and witnesses and file a chargesheet before court.

The other way is by filing a complaint under section 200 crpc before the concerned magistrate of the police station of your area. This is mostly done when you have the evidence and witness in hand which can prove the guilt of the accused.

In short, yes you can file a criminal complaint directly before the court without involving the police for criminal trespass, however you should be having some CCTV footage or any other hard evidence to make the court summon the accused.

for filing a criminal complaint the first step is you should file a complaint with police station you can file a return complaint also if it's been already 7 to 10 days that police is not taking any action then you can file the case in your district

hello sir, yes you can approach the court directly as well but it is always appropriate to exhaust all the legal remedies available to you before approaching the court. so that you can claim in your complaint that u have approached the court after trying all the remedies provided to you by the law
