Thumb Print attempted, but not obtained of an unconscious patient

Is it per se illegal or criminal to obtain a thumbprint of an unconscious patient in a hospital by a family member? An attempt was made by a family member, hospital staff objected, it was not done, but police want to interview.

It is totally illegal to obtain the thumbprint of an unconscious patient by anyone even if the person is related by blood. In that case the document where the thumb imprint is there will be invalid in the court of law and if a complaint is made then the police may take an action
