Threat of defamation case based on general social media post

23-Jul-2025 (In Criminal Law)
I posted a general concern on Facebook about a teacher pulling a student’s hair. I did not name the teacher, school, or student in the post, nor did I share any photos, tags, or direct identifiers. Now the teacher is threatening a defamation case and has been calling my relatives repeatedly to pressure me. She admitted to the act but says I exaggerated. Can I be held liable for defamation? Can I file a counter-complaint for harassment? What should I do next?

Since your Facebook post did not name or directly identify the teacher, school, or student, and was based on a matter of public concern without malice, it does not amount to defamation under Indian law (Section 499 IPC / Section 354 BNS, 2023). The teacher’s threats and pressure on your relatives could, in fact, be construed as criminal intimidation (Section 503 IPC / Section 131 BNS) and harassment. Yes, you can file a counter-complaint under relevant sections for harassment and intimidation at your local police station or through a magistrate under CrPC Section 200. Please also preserve all call records, texts, and any threats made. Documentation will strengthen your case. I regularly deal with such online/post-defamation threats and reputation defence cases.
