Taking signature on papers by misleading and breach of trust

28-Apr-2026 (In Criminal Law)
Sir, someone took advantage of my trust in the office and did financial fraud with the department. Now the police is after me and not ready to believe that I was unaware and was made to sign the papers.

The law is based on evidence, not words. You must prove that you did not intend to defraud (Mens Rea). Preserve all your conversations (WhatsApp, Emails, Call Logs) with that person. If they ever try to trick you or pressure you, these records will be very useful. Write a formal letter to the police and your higher authorities, detailing how your trust was exploited. Indian law states that a person is innocent until proven guilty. Save documents proving your innocence and follow the legal process.

Your situation is serious, but defensible if handled correctly from the start. What you are facing is common in office fraud cases— the person who signed documents is immediately treated as responsible. But liability is not automatic just because you signed. Legal position (important) Being made to sign without knowledge, or under misrepresentation, can be a valid defence against charges like: • Section 420 IPC • Section 468 IPC

If a person has signed documents that were later used for alleged financial fraud, the main legal issue will be whether there was knowledge, intention, participation, or benefit. In India, police and departments usually examine: * Who prepared the documents * Who benefited financially * Whether signatures were obtained by misrepresentation * Whether the accused had authority and control * Whether objections were raised earlier * Digital, banking, and office records You should immediately focus on creating a documentary defence instead of only giving oral explanations. My advice 1. Preserve all evidence * Keep WhatsApp chats, emails, call records, office instructions, attendance records, file movement details, and signatures. * Preserve proof showing who actually handled accounts, vouchers, or transactions. * Keep evidence that you did not receive money or personal gain. 2. Prepare a detailed written representation Submit a written explanation to: * Investigating Officer * Department authority * Senior police officer if needed.

File a complaint that you have signed the papers under coercion. Anyways having a statement before police have no evidential value. Simultaneously file a criminal complaint of breach of trust , cheating, fraud and misuse and misappropriation of money
