Subject: Legal Advice Needed Regarding Precautionary Defense Against F

24-Aug-2026 (In Criminal Law)
I am a resident of Delhi NCR. As part of improving my social and communication skills, I frequently visit public and commercial spaces (like premium malls, high streets, and cafes in Connaught Place, Saket, and Gurugram) to initiate polite conversations with unfamiliar people, including women (commonly referred to as 'Cold Approaching').My intentions are purely social and respectful. However, keeping the current legal scenario in mind, I want to proactively understand my legal rights.

There is no bar in approaching random people and striking a casual conversation. However be careful in approaching random women as you might be accused of harassment and even stalking. Depends on the situation, be polite and respectful and do not pursue if the other person is hesitant or shows any aversion to having a conversation.

Unwelcome physical contact, sexual remarks or advances may attract Section 75 BNS (sexual harassment); following or repeatedly contacting a woman despite clear disinterest may amount to stalking under Section 78 BNS; and insulting gestures, words or intrusion upon privacy may attract Section 79 BNS.

:* If the other person shows disinterest, discomfort, or asks you to leave, you must stop immediately. Continuing despite clear disinterest can amount to harassment / stalking under Section 78 of BNS [354D IPC]. 2. *Content of conversation:* Polite social talk is fine. Any sexual coloured remarks, sexually explicit questions, demand for sexual favours, or unwelcome physical touch will attract Section 75 of BNS [354A IPC] - Sexual Harassment, which is a cognizable offence. 3. *Private property:* Malls in Saket, Gurugram, cafes in CP are private properties. Management has the right to ask you to leave if they receive complaints. Refusal can lead to trespass / public nuisance issues. 4. *Recording:* Do not photograph/video any person without consent, especially women - attracts Section 77 BNS. Best practice is to keep interaction brief, respectful, in public view, and disengage immediately if not reciprocated. If you want to improve communication skills, join curated social clubs / networking events where interaction is expected.
