Can a judge issue summon in 420 criminal complaint case without taking cognizance

we would like to inform you that as per the new law statutory law directs to the complainant/ informant to issue preliminary notice prior to cognizance to the accused so that accused place may appear and give stand; and, based on his stand court further take cognizance. this right is beneficial for the accused to satisfy the court about involvement in the case.
