You can challenge the false FIR by filing a petition under Section 482 of the Code of Criminal Procedure, 1973 (BNSS 528) before the High Court to quash the FIR on the ground that it is false and malicious. You can also file a claim petition under Section 166 of the Motor Vehicles Act, 1988 before the Motor Accident Claims Tribunal (MACT) seeking compensation for the death of your husband in the accident. The Tribunal can award compensation even if the vehicle was not traced immediately, provided you can prove the accident and negligence through available evidence, including the post-mortem report and witness statements. If the accused party is influential, you can approach the State Human Rights Commission under the Protection of Human Rights Act, 1993, for inaction or harassment by the police. As you are financially distressed and living with cancer, you may also apply for legal aid through the District Legal Services Authority (DLSA) under the Legal Services Authorities Act, 1987, to get free legal assistance for pursuing your case. I’m sorry for your loss. If a false FIR was filed against your husband and the actual offending vehicle is missing, you can seek justice by filing a petition before the Madurai District Police Superintendent requesting proper investigation and action against the real offender. You may also file a Writ Petition before the Madurai Bench of Madras High Court seeking direction for fair investigation. Additionally, you are entitled to claim compensation under the Motor Vehicles Act through the Motor Accident Claims Tribunal (MACT), even if the vehicle is unidentified. As a widow with no income and suffering from illness, you can also request legal aid through the District Legal Services Authority (DLSA) in Krishnagiri. They will provide free legal help. Do not lose hope—legal remedies are available. — Adv. Venkatakrishnan, Apex Law Office LLP, Chennai.
