RWA is blocking us from entering the park with our dog. Manhandling

We are facing consistent issue from RWA who purposely is sending us threats to block us from entering the park with my dog. I am a Dog parent and consider it a right for my dog to have healthy lifestyle. Today they sent a woman to manhandle and push us out of the park. On daily basis it has become a mental harassment. I want to legally challenge the RWA on this matter. Please advise my rights. So I can take the precedings ahead. I am resident of Shanker Garden, Vikas Puri, New Delhi

You must file a case against the RWA as well as the persons involved in the said act. There are multiple laws in India including Prevention of cruelty to Animals Act 1960 which protect the rights of animals.

Your right to not get assaulted or restrained is a given. However, to take your dog to a park maintained by an association/government is limited. Such right can be curtailed to prevent public nuisance but certainly not at the cost of assaulting/wrongfully restraining/harassing you. This matter would depend on several factors though I have mentioned just one for what I could gather from your statements. you may file a civil suit. if wrongfully restrained/assaulted , you may file a criminal complaint/FIR.

First u need to understand that whether municipal departments have given permission for pets to enter the park. Therefore first we have to file an RTI at the department…after that we have to see things how to sue RWA
