requesting preservation of digital evidence legally safe?

21-Jun-2026 (In Criminal Law)
I am connected to an ongoing criminal investigation in Tamil Nadu and have been cooperating with the investigation. I plan to send two neutral representations to the District SP: (1) a precautionary petition for record/safety purposes, and (2) a request to preserve legally obtainable digital records (CDR, call logs, SMS, tower data, metadata) due to retention limits. Are these legally safe, and could they trigger police scrutiny, station visit, or PP objection?

Yes, generally these two representations are legally safe if they are written in a neutral, factual, and respectful manner. A precautionary petition for record/safety purposes and a request that legally obtainable digital records be preserved due to retention limits are ordinarily seen as administrative requests rather than interference with the investigation. That said, any representation sent to the District SP may be forwarded to the Investigating Officer and could lead to a call, clarification, or routine inquiry, but it does not automatically mean police scrutiny, a station visit, or an objection from the Public Prosecutor. The key is to avoid directing the investigation, making allegations, or seeking access to records yourself, and instead simply request that any relevant material be preserved in accordance with law if the authorities consider it necessary.
