Request legal advice on obtaining my jail medical, psychiatric, and bl

08-Jan-2026 (In Criminal Law)
I was arrested in connection with a suicide case. During my judicial custody at Sub-Jail, a blood test and medical and psychiatric examinations were conducted on me on 29-08-2025. Around 135 days have passed and the charge sheet is still pending. I want to know whether I am legally eligible to obtain certified copies of my blood test, medical, and psychiatric reports through RTI or by court directions. Please advise.

Yes, you are legally entitled to obtain copies of your blood test, medical and psychiatric examination reports, but the proper route is through court directions, not RTI at this stage. Since the case is still under investigation and charge sheet is pending, such records form part of the case diary / investigation material. Under law, RTI is generally barred for documents connected with an ongoing criminal investigation. You should file an application before the Jurisdictional Magistrate seeking certified copies or inspection of your jail medical, blood and psychiatric reports, stating that they relate to your own health and defence. Courts usually permit access, especially when reports concern the accused’s physical or mental condition. Once the charge sheet is filed, you will be automatically entitled to copies of all relied documents under law. Till then, court permission is the correct and effective remedy.
