If your name has been falsely added in a domestic violence or criminal case, the first and most important step is to challenge the false allegations in the same court where the case is filed. You may file an application for discharge or approach the High Court for quashing if allegations are vague and without specific role. Regarding defamation, technically you can file a criminal defamation complaint if the allegations are knowingly false and have harmed your reputation. However, courts generally advise defending the main case first. If the complaint is malicious and clearly fabricated, defamation or malicious prosecution action can be considered later. As to jurisdiction, if the case is registered in Delhi, you must contest it in Delhi. You cannot shift the case to Pune unless you approach the Supreme Court for transfer on valid legal grounds. Focus first on strong legal defence and discharge strategy.

Under Indian law, defamation is covered under: Civil Defamation – Law of Torts (claim for damages/compensation) Criminal Defamation – Section 499 & 500 of the Indian Penal Code An advocate checks whether these essential ingredients are present: ✔️ A statement was made (spoken, written, published, social media etc.) ✔️ The statement concerns the complainant ✔️ The statement was published to a third person ✔️ The statement harmed reputation ✔️ There was intention/knowledge that it would harm reputation If any one ingredient is missing → case becomes weak.

If your name was falsely added, you may file a criminal defamation case under IPC 499/500 by proving false and malicious intent. File where cause of action arose or where reputation was harmed, subject to jurisdiction rules.
