Query Regarding Release of Recovered Property in Theft Case

20-Jun-2026 (In Criminal Law)
Sir, My stolen phone/laptop has been recovered and is in court custody. 1. Is any court fee or cash deposit required for release? 2. Is the surety amount only a bond/undertaking or do I need to pay it upfront? 3. If it's only a bond, when does the liability to pay arise? 4. Is there any specific practice followed in Durgapur/West Bengal courts regarding this? Thank you.

Based on the facts stated, if your mobile phone or laptop has been recovered and is lying in court custody, you may apply before the concerned Magistrate for interim custody/release of the property (commonly known as Zimma or Supurdari). Generally, no court fee is payable for the release of the property, though nominal procedural expenses may apply depending on local rules. The surety amount mentioned in the order is ordinarily a bond/undertaking and is not required to be deposited in cash upfront, unless the court specifically directs a cash security. Liability to pay the bond amount arises only if the terms of the bond are violated, such as failure to produce the property before the court whenever directed. In West Bengal, including Durgapur courts, the usual practice is to release the property on execution of a bond with or without surety after verification, subject to the court's satisfaction and the facts of the case. The exact procedure may vary depending on the stage of investigation and the court's order. Kindly consult the case records and the release order before proceeding. for durgapur you can call me

here's the detailed answer to your queries 1. Court Fee or Cash Deposit: No substantial cash deposit or heavy court fee is required to get your stolen property released (a process known as Superdari or Zima). You only need to attach nominal court fee stamps to your application. 2. Upfront Payment vs. Bond: You do not need to pay the surety amount upfront. The court will require you to execute an indemnity bond (Superdarnama), which is essentially a written undertaking. You may also be asked to provide a local surety (a guarantor). 3. Liability to Pay: The financial liability only arises if you violate the conditions of the bond. For example, if you sell the device, alter its data/appearance, or fail to produce it before the Magistrate when ordered during the trial, the bond amount can be forfeited. 4. Specific Practice in West Bengal: The core procedure is governed by standard Indian criminal procedure law and is uniform. However, magistrates in Durgapur/West Bengal (as in many other jurisdictions) commonly mandate that you submit detailed, attested photographs of the phone/laptop along with the bond before the physical item is handed over to you.
