Your question is not clear . For filing a petition to quash an FIR on the basis of settlement , the de facto complainant is required to file an affidavit affirming the settlement . If the affidavit is executed in India , it may be attested by an Advocate or notarized . If executed outside India , it should be notarized and duly attested by the concerned Indian Embassy / Consulate . For further details or legal assistance , please feel free to contact me

You can safely proceed by filing the quash petition only for A1 and A2, clearly stating in the affidavit that A3 is presently in Dubai and has not joined the petition; the High Court can quash proceedings insofar as A1 and A2 are concerned while the case continues against A3, and later A3 may file a separate quash petition
