Quashing of fir registered under PC Act

Sir, I have been arrested in pc act. Our chargesheet is produced before the court without production of a valid sanction from the competent authority. Can this be a ground of quashing of fir or discharge?

If there was no valid sanction from the competent authority before the court took cognizance, it can be a ground for discharge. However, FIR cannot be quashed merely on absence of sanction. We must first verify whether sanction exists on record and whether it was obtained before cognizance. Proper remedy would usually be filing discharge application before the Special Court.

yes for this an application is to be made before the Honorable high court and the court may consider the ground for the quashing if the matter is put up in High court and if there are many loopholes in the chargesheet then chances are there
