Quash - 41a not followed by Police during the arrest.

Dear Sir / Madam,
Can you please give any reference Judgement / orders of Hon'rable HCs or SC of India.
Where the case is quashed / set-aside because the Police have NOT complied to IPC section 41a and arrested the accused illegally?
Brief: My father aged 66 years was arrested by police illegally U/s 420 & 406 of IPC.

In this case, i advice you that there are lot of judgments from Lalita kumari judgement. Moreover, it is advisable not use the illegal arrest point only. You can very well show vindcitvness of the police officials in arresting your father without giving notice but the same cannot be only ground of getting wishing effectively.
