Procedure to file a case when cheque bounces

First you have to send a demand notice through lawyer within 30 days of bouncing.then if the party does not make payment within 15 days of receiving notice then you have to file case within next 30 days .

You have to received a cheque return memo from your bank where you presented your cheque.thereafter you have to send notice u/s 138NI Act within 30 days from the date of receiving cheque return memo.after waiting 15 days from the date of notice if any payment is not made by
Accused,u can file cheque bounce case

Generally a cheque is valid for 3 months from the date of issue. The time limit for filing a case under Section 138, NI Act is one month immediately following the day on which the period of 15 days from the date of the receipt of the legal notice expires.
