Procedure to apply for anticipatory bail

Sir, my father has filed a case in Punjab & Haryana High court dated 10-Oct-2017 for anticipatory bail against section 420/465/467/471/34 IPC, but on that day we got next date of 20-Nov-2017 & then again got next date of 12-Feb-2018. Its departmental case but my father is already retired two years ago. Sir, please suggest me what we should have to do as it is taking a long time to bail.

u just apply for ant bail. the police will submit CD in the case/court when called for. after hearing the case and upon the submission, if the court is satisfied, ant. bail will be granted. u have not provided under what sectons charges has been done. based upon the gravity of offence, order of ant. bail will depend

MY OPINION THAT according the criminal procedure code and the statute of proceedings, police is bound to submit the case dairy at the respective Hon'ble Season court, actually it is basically depends upon what the actual matter is and what are the basic of case dairy in what respect, all the circumstances are the main factor, contact with me .

First of you should know whether your nephew is named in for or not if he is not named in for then in that case you should have not applied for anticipatory bail if he is named in for and you have applied for anticipatory bail and case diary was not submitted then it's not a big issue it will be submitted in the next date of hearing even if it is not submitted in the next date it is the duty of your lawyer to pray before the LD court to direct the io of the case to bring the case diary at the time of hearing.

You have not clearly mentioned whether you got interim order or not. In such type of anticipatory bail cases ordinarily court grants interim bail and directs the person to join the investigation then after joining the investigation bail is confirmed. You have to consult your advocate and do the needful in the same case

firstly you have checked how much old the matter involved in the FIR. if the matter involved in the FIR was less than two years old. then there is no problem and your father will get the anticipatory bail and if the matter involved in the present FIR was more than two years old, then you have checked the role of your father, then file the bail
