25-Sep-2025 (In Criminal Law)
Police lifted me from home just based on complaint(harresement complaint) by my wife . When i asked about complaint copy or details about complaint they didn't provide . Later i also got impulsive as they did this for 2nd time. Later they put criminal case on me saying i did obstructed in police work. Can i take action on police for taking me to police station for not telling what complaint is about . Even if there is complaint , is it required for us to go to police station without FIR ?

*Understanding Your Situation* You were taken into custody by the police from your home based on a harassment complaint filed by your wife. You weren't provided with a copy of the complaint or details about it. When you asked for the information, you became impulsive, and the police later charged you with obstructing their work. *Key Points to Consider* - *Right to Information*: In India, the police are required to provide you with the grounds of arrest and the details of the complaint against you, as per Article 22(1) of the Constitution and Section 50 of the Code of Criminal Procedure (CrPC). - *Arrest without FIR*: The police can arrest someone without an FIR in certain circumstances, such as when they have reason to believe that the person has committed a cognizable offense. However, they should still provide the grounds of arrest and inform the person about the complaint. - *Obstructing Police Work*: If the police charged you with obstructing their work, they would need to prove that you intentionally hindered them in performing their duties. *Possible Actions* - *File a Complaint*: You can file a complaint against the police for not providing you with the details of the complaint and for taking you into custody without proper procedure. You can approach the Superintendent of Police (SP) or the District Magistrate (DM) with your grievance. - *Seek Legal Counsel*: Consult a lawyer who can guide you on the best course of action and help you navigate the legal process. They can also assist you in filing a complaint or seeking bail. *Next Steps* - *Gather Evidence*: Collect any evidence or witnesses that can support your version of events. - *Consult a Lawyer*: Get legal advice to understand your rights and options. Do you want to: 1. Know more about your rights during police custody? 2. Understand the process of filing a complaint against the police? 3. Get guidance on seeking legal counsel? Let me know!

Police cannot forcibly take you to the station merely on the basis of a private complaint without registering an FIR or issuing proper notice under Section 41A CrPC. You have the right to know the nature of the complaint against you. If they detained you without following procedure, it amounts to illegal detention. You may challenge their action by filing a complaint before higher police authorities. However, obstruction of police work can be used against you if you resist. Therefore, it is advisable to cooperate but also insist on your legal rights, including receiving a copy of the FIR (if registered) or notice. You may also pursue departmental action against concerned officers for misconduct and seek legal remedy for unlawful detention.
