Police officer tried to plant evidence in car during checking.

16-May-2023 (In Criminal Law)
Sir/ Madam, While returning from a movie, I passed from a barricade with my car windows closed and AC on. The on duty officer gestured me to stop and alleged that he has reason to believe that I am drunk while driving, because he smelled some odour from my car while passing barricade. He made me step out of the car and asked for documents, while another officer started searching my car. They opened all the bags, gifts and boxes that were in the car and tried to put a weird towel in one of my bags. When I asked them if I can record the search they refused & took me in the booth and asked me for additional documents. Query: - I wasn’t drunk & I co-operated with them. Was the search legal? Can we record our search? Can they plant evidence & get away with it? What could an ordinary person do in such scenario?

The police officials are not legally entitled to search your vehicle or any belongings of you without a search warrant. And you have got full right to record if you have reason to believe that such an act is illegal. For more legal assistance I am just a call away.
