Police harassment who misuse their authority

03-Oct-2024 (In Criminal Law)
For several months, I have been experiencing continuous harassment by police officers. Police vehicles approach and activate their sirens near me at the loudest volume, only to cease them once they move away. This harassment is particularly pronounced during night patrols when the sirens are activated near my house at the loudest volume, causing significant disturbance and distress. Despite my efforts to report it to SP, Nhrc, no action has been taken yet. What should i do?

Respected sir As far as I understood your problem, you have a fit case for filing a P.I.L. before the Hon'ble High Court to get a permanent solution to this. However, it is not possible to give you all the details here, you may consider consulting me in that regard.

To address your query: You can take a few legal steps to handle the harassment. First, send a written complaint to the Superintendent of Police (SP) and keep a copy for future reference. If no action is taken, you can approach the State Human Rights Commission (SHRC) or National Human Rights Commission (NHRC) with a formal complaint, attaching all evidence like your previous reports to the SP. Additionally, you may file a writ petition under Article 226 of the Constitution in the High Court, seeking directions to the police to refrain from harassing you. It would also help to gather video or audio evidence of the police vehicles disturbing you at night to substantiate your claims.
