Pocso7/8 . I m the accused . Please help

I am the accused in pocso7/8 . It's been 1 year but victim and informant is not coming to court for chief examination. They just did FIR and now escaping to come to court. Summon has been issued but still they are not appearing in court. Just because I am accused I am going through the trouble. My lawyer is also not taking any step as he only care about his fees and judge is only giving date. I don't want to go high court and pay another lawyer fees. Judge and lawyers are irresponsible

I have received your query regarding your case and talked to the lawyer and said to to the lawyer court also gives nbw warrant of the complainant also police officer also searched the victim and they produce the victim in the court

Dear Sir, In the scenario as explained by you above you can either change your lawyer and retain other advocate or you can ask your advocate to mention before the Court about the underlying issue. And it would also be a better option if you go to the High Court.

If the witnesses are not appearing despite summons, you can request the court to act under Section 22(1) of the POCSO Act for non-compliance, and use Section 35 to push for a speedy trial. Your lawyer should file an application for immediate action. If they are not proactive, communicate your concerns and push for faster steps. Consider hiring another lawyer if this continues, as it might expedite your case.

If the complainant is not coming before the court even after summons then warrants can also be issued against her. Then it will be the duty of the police officials to get the complainant in the court. For more legal assistance I am just a call away.

let it be it's your choice not to approach the high court or engage another lawyer. but by not making decisions only you will suffer. Better, engage another lawyer, who is more interested in execution of your case and his fee as well.
