Physical abuse in Road Rage on a road in Bangalore

07-Sep-2023 (In Criminal Law)
Hi - I had an awful experience. Was driving on road and about to take a turn was ahead in queue. Car ahead of me was slow to move off the signal to turn but the guy in car behind lost patience he thought it is me delaying he honked like anything. Then I showed him hand gesture what's the rush. He then followed me and asked me to stop somewhere. As I got down of the car he came and started abusing me and finally pushing me vigorously. I was shocked by his behaviour tried to call police but as I was in a rush had an appointment to meet took his details like car photo. Possibly there might a cctv camera on road. I really want this guy to be taught a lesson as he cannot think he owns the road. Please advise what legal action I can take against him. I think first step would be to place an FIR in area where this happened. This guy was physical with me for no reason. I could have fought back but as I was with my mother I didn't react.

As per the Kerala High Court, one comes across various instances of road rage, violence and assaults on the roads, putting the drivers and passengers of vehicle at risk. Any person who engages in a course of conduct that causes or threatens an impact involving damages to another vehicle is guilty of road rage. Although to date there are no specific provisions under the Motor Vehicle Act or the penal statutes which makes road rage a punishable offence, section 19 of the Motor Vehicle Act, 1988 provides the power of licensing authority to disqualify from holding a driving licence or revoke the licence if such person has, by his previous conduct as the driver of a motor vehicle, showing that his driving is likely to be attended with danger to the public.
