The object in custody of court is called as "MUDDEMAL" and you need to know the case number and in which court the case is going on after which you have to make an application to the concerned court to get back your mobile and along-with it will be better if you attach the bill of the mobile. After-which the court will make an order with or without conditions to return the mobile to you.You may have to give a bond to court for it please consult a lawyer it is a simple process and surely you will get back the mobile.

You will have to appear before the court for identification . Once ur identification is over then court will pass an order. Its easy but sometimes time consuming. Thanks

You can file application under cr.p.c to get ur fon recovered.

You personally can do it or you may engage a lawyer of ur choice.

This will take one or two days and not expensive more than thousand rupees (cost may vary as per standard of lawyer it varies from 5 % to 10%)

Thanking into consideration the above facts.
You need to make an application for return of property via a lawyer to the court. There after the judge will pass an order to get give you mobile phone back to you.
Subject to verification by that the property you have claimed belongs to you.

Best regards .

Hello,

The procedure for you to recover your Phone would be that now you need to File an Application for Return of Property u/s 451 of the CRPC before the Magistrate Court under which the Concerned Police Station is reported to. You will have to furnish the required documents like the Bill of the Phone. The Magistrate will pass and order directing the return of the Mobile phone to you and you will have to show the order copy to the Police Station and on doing that they will return your phone to you.
