Person damaged my property due to drunk driving

Hi, Someone hit his car to my house two days back and he was fully drunk. We complaint in police and they ask us for compromise and wrote a note mentioning that party will repair all loses. But now it is third day and he not taking appropriate action. What should I do if he disavow the written commitment? Is the any law against him? I am in mess and police said we can't file case against him as you compromised that time. Any solution?

Yea you can file a fresh complaint referring to the previous one that the compromise was on the grounds that the person would take care of all the expenses incurred on repairing the car. He has failed to and I take back my compromise and want action to be taken against him
