Party not giving the passport of another person after many requests

A person (A) Whose passport has been illegally held for a meager hand loan by his friend (B). Despite repeated requests and various representations for about eight years, Person (A) was continually denied. Last year, the Person (A) expired because of the stress , When his spouse and children went and asked the passport from the so called friend (B). They were informed that the Passport was thrown to Bin after the demise of Person (A). The conversation held between Person (B) Wife and the Person (A) Wife was recorded. The Question is Can the spouse and children claim Person (A) passport? Can the Spouse of Person (A) lodge a Complaint against Person (B) and his wife who is a co conspirator? If so, Where should they lodge a complaint and on what grounds? Is the recorded conversation sufficient enough to file FIR? If so, Under which category of IPC, It can be filed.
