One relatives cheated 6lakhs in the name ofChit fund fraud

One of Friend cheated so many people in our town. He takes Rs in CASH from all of us and gives X amount as interest. As he takes rs in cash we do not have any legal evidence. Cheat amount is nearly in 5 to 8 crore. As of now he run away from town and all his cell phones are switched off and no one knows where is he. As we have given CASH amount to him can we file legal case

it appears that you have given money to him for interest and the amount transferred in account can be recovered by means of money suit, however, do note no subtantial claim can be placed for amounts given as cash as it appears you yourself had lend the money for esurius interest, which is an offence in itself, so the chance of lending such money itself is at risk, thank you

Yes, even if the amount was given in cash, you can still file a criminal complaint for cheating (Section 420 IPC) and criminal breach of trust (Section 406 IPC). Gather whatever proof you have — WhatsApp chats, call records, witnesses, or any indirect evidence. File an FIR at your local police station with all affected persons' names and details of the transactions. If the police delay, you can approach the Magistrate Court under Section 156(3) CrPC. You may also consider a public notice and apply for Lookout Circular if needed.
