Need to reject 301(2) application filed by complainant

The complainant (CW1) has no evidence and asked for extra time twice during cross on 3 different dates CW1 said evidence shall be produced nothing produced. Later CW1 wanted to withdraw the case but accused refused to give any letter. CW1 took accused lawyer’s phone number to make compromise did not work. Now CW1 filed 301(2) to delay the case. Can I oppose it as delay tactic saying PP will only safeguard accused rights. Private counsel with only start vindictive battel. Case stage evidence.

Dear Sir, Definitely you can oppose such application. if allowed the role of private advocate is very limited. in the meanwhile you may approach the High Court for a direction to dispose the case within a time period. Thus you will get justice.
