Necessity of marriage photo evidence for claiming maintenance

22-Feb-2023 (In Criminal Law)
I had filed a petition in court in order to get maintenance from my husband as he was refusing to give me any money after he got involved in an affair with my cousin sister. Do I have to produce a photo evidence of my marriage in order to claim maintenance under section 125 CrPC?

No strict proof is needed in court to claim maintenance under 125 CrPC, prevalence of marriage responsibilities is enough to prove marriage. However, a marriage certificate can act as a good proof in such cases. Therefore, photo evidence is not a necessity but can be a valid proof in your case.
