FIR के पश्चात पुलिस द्वारा जाँच की जाती है तथा साक्ष्यों के आधार पर ही आगे की कार्यवाही एवं चार्जशीट दायर होती है। यह स्पष्ट किया जाता है कि FIR दर्ज कराने या चार्जशीट दाखिल करवाने हेतु किसी प्रकार की धनराशि देना या देने का प्रस्ताव करना कानूनन अपराध है। संपूर्ण प्रक्रिया विधि के अनुसार संचालित होती है।
यह भी आवश्यक है कि शिकायत पूर्णतः सत्य तथ्यों पर आधारित हो, क्योंकि असत्य या दुर्भावनापूर्ण शिकायत की स्थिति में शिकायतकर्ता के विरुद्ध भी कानूनी परिणाम संभव हैं। अतः आगे बढ़ने से पूर्व सभी तथ्यों का विधिक मूल्यांकन आवश्यक है।
