Messed up FIR for phone theft – urgent help

31-Oct-2025 (In Criminal Law)
Hi, my phone got stolen. In panic, I filed an online FIR but entered wrong IMEI (my other phone). Next day, went to the station. Lady officer said “file another report with correct IMEI” . I misunderstood and filed a second online FIR with correct IMEI Info. Now she’s very angry, says she meant and LR, not FIR, (she didnt knew my first complaint was also fir not LR) and 2nd FIR must be cancelled. Asking me to come at 4 PM – I’m scared. Please tell me: Can police cancel 2nd FIR or punish me?

Do seek a detailed legal consultation from an Advocate and brief him about your case. Do get the contents of fir legally perused and seek his opinion as to how to proceed. Dont visit the Police Station alone. Do engage a lawyer and visit with him only.

Subject: Report of Mobile Phone Theft and Reason for Delay in Lodging the Complaint To, The Officer-in-Charge, [Name of Police Station], [City/District] I, [Your Name], resident of [Your Address], respectfully wish to inform you that my mobile phone (make, model, IMEI number if available) was stolen on [date and time] at/from [place of incident]. At the time of the incident, I tried searching for the phone on my own, assuming it might have been misplaced. I also attempted to track the device through available applications and contacted nearby people/locations to recover it. However, despite my best efforts, I could not retrieve the phone. The delay in filing this report is unintentional and purely due to my belief that I would be able to find the phone without needing police intervention. Additionally, I was under stress and occupied with personal/professional responsibilities, which caused further delay. I now understand the importance of officially reporting the theft. Therefore, I request you to kindly register my complaint and take necessary action. I shall fully cooperate with the investigation. Thanking you, Yours faithfully, [Your Name] [Contact Number] [Date]

There is no reason to panic. Your situation is very common, and the law is completely on your side because you acted in good faith after your phone was stolen. Filing two online reports with different IMEIs is treated as a mistake/confusion, not a criminal offence. The police can simply cancel or club the second FIR through a cancellation report or by converting one of the reports into a Lost Report (LR). This is an internal administrative step for them, not a punishment for you. You cannot be penalized for a genuine error made while reporting theft. When you go to the station at 4 PM, calmly explain that you misunderstood the officer’s instruction and thought you were required to file a corrected report. The officers will verify both entries, keep only the correct IMEI report active, and mark the other one as canceled or “mistaken entry.” That formally resolves the duplication. You should carry your ID proof, IMEI numbers of both phones, and any acknowledgement you received online. This will help them update the correct information quickly. As long as you cooperate and explain honestly, they will not take any action against you. This is a routine correction for them. If you want, I can also prepare a short written explanation that you can hand over to the officer to make the process easier.
