Maintainability of dacoity charges if 4 of 5 accused persons are dead

When 4 of the 5 accused people involved in dacoity case are dead (car accident) and 1 person is charged with common intention, what is the maintainability of an appeal for the accused who are alive? Will they be charged for dacoity as the number is now less than 5?

your question seems to be vague you haven't mentioned the stage of the aforesaid case that plays a major role. if the said persons involved in dacoity died prior to filing of chargesheet then the appeal wont be maintainable however if they have died after their conviction then the appeal is maintainable
