Long distance relationship with intimacy for 7 yrs-avoiding marriage

17-Jul-2025 (In Criminal Law)
In long distance relationship from 2018. When asked for mrg he said so many excuses for 3 yrs so I waited for 3 yrs. Now totally refused to marry. We've been intimate since 2018 till May this year with promise to marry. I said everything to his family but they humiliated me and said their son will never do like this. He lied about everything happened between us to them. But I have proofs. Even I showed the proof his parents didn't believed me. If I file a complaint to marry him what'll happen.

Without any anticipation, try to lodge a complaint against him through proper channels, and substantiate your allegations through the evidence that you have. Try not to give your one and only proof to anyone, always share a copy of your evidences until you meet the ends of justice.

hi, I can well understand your concern from the query raised, if there has been a promise of marriage during your time together it amounts to a cheating and criminal breach of trust and the act would amount to rape under convincing circumstances, thank you

Dear Client, 1. You can file a police complaint under Section 376 and Section 417 (cheating) of IPC if you have strong proof that he had physical relations with you only by falsely promising marriage. The court will examine your evidence and intent behind the promise. 2. You may schedule an appointment regarding your case by phone or email at your convenience. Thanks & regards, Priyanka Advocate Coimbatore

If you file a police complaint, it may be registered under Section 417 IPC (cheating) and Section 376 IPC (rape on the false promise of marriage), based on your evidence and the nature of your relationship. The police will investigate the facts, including your proof of the promise and physical relationship. If satisfied, FIR may be registered and the accused will be called for inquiry or arrested. The court will then decide based on evidence whether the consent was obtained through deception. If you seek marriage and not punishment, you may opt for mediation through police or women’s commission. However, be aware that the law does not compel a person to marry, but criminal liability arises if deceit and exploitation are proven.
