Loan recovery given to a Pvt Ltd company
25-Jul-2023 (In Criminal Law)
2 post dated cheques were given to me of 2 lacs each as I was suppose to get my 4 lacs back. The first was valid from 10th June 2019 and the second from 10th sep 2019. Now on the 10th June 2019 , I was called and informed not to submit as there is no money in account. After 20 days 50000 was given and promised to give the rest within few days. After 1 month the concerned persons are not responding and neither replying to sms, emails. I have both the cheques.
If the cheques are stopped than can I file a complaint or if I submit now and it gets bounced than will it be valid case as they paid 50k.
Sir, My sencere advice to you that first you go ahead of present the cheques in your Bank. let it be come the results with insufficient funds or stopped payment or any other reasons. If the company wants to stop the payment on cheques, then the company has to follow up certain procedure, in your case the company has not brought the notice to you that the cheques kindly be not present due to stoped payment for the reason that insufficient funds or any other reasons stated. Therefore first present them, let it be come result with any reason, you can file the private complaint in respect of cheque bounce. Contact me once I will guide you and make it proper way. thank you.
