legalise the digital informatino in my smartphone for evidene

19-Sep-2026 (In Criminal Law)
Hello, There is a feature in google maps known as Timeline which when turned on, tracks and stores all travel activities in the app. I have mine turned on since 2019, and have some travel records and logs which can act as a crucial evidence in a False BNS 85 filed against me and my family. My query is how do i legalize that digital data so as to present it in the court? Will the court even accept it?

Yes, Google Maps Timeline data can potentially be relied upon as electronic evidence in a BNS Section 85 case, but it should be properly authenticated. Since the records are maintained electronically by Google, preserve the original Timeline data and obtain/export it directly from your Google account, preferably along with the relevant account/device details and metadata. For court, the electronic record should ordinarily be accompanied by the appropriate certificate under Section 63 of the Bharatiya Sakshya Adhiniyam, 2023 (BSA), establishing how the electronic record was produced and its authenticity. Screenshots alone may be insufficient. You can file the Timeline data with a Section 63 certificate and explain specifically how the location history contradicts the allegations. The court will decide its evidentiary value after considering authenticity, continuity and other evidence.
