Legal recourse for theft of travel card issue by bank

23-Feb-2023 (In Criminal Law)
I had applied for a travel card from a bank. While issuing the card the Bank gave me two cards instead of one and said the second card is for back up. When I went abroad I was carrying one card with me and my wife was carrying the second card. This is because the bank representative had assured the card is chip protected and requires PIN. So even if one card is lost the second one can be used. On the second day the card which was with my wife was stolen and it was misused. This is in spite of the card being protected with a PIN. We followed all the process to file an insurance claim with the bank and after making us wait for more than 3 months and continuous follow ups they said the claim has passed and asked for my bank details. After almost more than a month after that when I kept following up with them they now tell me the claim has been rejected as the card was with my wife. What legal recourse can be taken in this case?

You will have to file a police complaint stating the theft of the said travel card and then the investigation will take place if the card was not misused by two of you the insurance company as well as the bank is required to trace the card and provide you with the suitable claims. If the company denies the same then you can file a complaint in the consumer forum.
