Even if FIR is not yet registered, courts allow anticipatory bail when: A 175 BNSS (old 156(3)) petition has been filed, And the accused demonstrates a genuine belief that an FIR is likely to be ordered, leading to arrest. Many High Courts and the Supreme Court have held that: A person can seek anticipatory bail even before FIR if there is a clear threat of arrest. So legally, anticipatory bail is maintainable before or after the Magistrate passes an order directing FIR.

A petition under Section 156 BNSS can lead the court to direct the police to register an FIR. If there is a possibility of arrest, you are allowed to file for anticipatory bail. So yes, you can file anticipatory bail.

Yes, you can apply for anticipatory bail, because a 175 BNSS petition may lead to FIR-registration. To stay protected, file AB immediately. I can prepare a strong, urgent AB petition for you so you stay fully safeguarded.
