09-Mar-2026 (In Criminal Law)
I was in a relationship with a person for around 8 years. During this time, he repeatedly promised to marry me and also met my parents several times to discuss marriage. Ma’am you are within your rights to invoke the appropriate legal recourse. However, in such a situation notice is not an appropriate course of action. For precise advice detailed analysis of your facts and evidence supporting those facts are necessary.

Apart from a legal notice, you also have certain legal remedies. If it can be shown that he induced you into the relationship on a false promise of marriage without genuine intention to marry, a criminal complaint may be filed for false promise of marriage under the Bharatiya Nyaya Sanhita. In appropriate circumstances, a complaint for cheating may also be considered. And also you need to tell what chats you have as an evidence.

Yes, you can send a legal notice before initiating any legal proceedings. A notice can be issued calling upon him to clarify his position regarding marriage and to explain the conduct of abruptly refusing the relationship after a long period of commitment. Sometimes such a notice leads to dialogue or settlement. Legally, if it can be shown that the relationship was continued on the basis of a false promise of marriage made from the beginning without genuine intention to marry, criminal remedies may be available under the Bharatiya Nyaya Sanhita, 2023 for cheating or deception. Courts, however, examine whether the promise was genuinely made but later could not be fulfilled, or whether it was false from the outset. Evidence such as messages, photographs, meetings with families, and other communications can be relevant in determining this. You may also explore civil remedies, including seeking compensation for mental harassment if there is clear evidence of deception and misuse of trust. Before initiating criminal proceedings, it is generally advisable to consult a lawyer with all available evidence so that the appropriate course of action can be evaluated. Therefore, issuing a legal notice can be a first step, after which depending on the response and the evidence available, you may consider filing a complaint before the police or approaching the court for appropriate legal remedies.

You can certainly initiate legal action by sending a formal legal notice for the breach of promise to marry, especially given the eight-year duration and parental involvement. Under Indian law, if the promise was made with a fraudulent intent to establish a relationship (deceitful promise), it may attract criminal charges under Section 69 of the BNS (formerly explored under 417/376 IPC). Additionally, you can file a civil suit for damages to seek compensation for the severe emotional distress, mental harassment, and loss of reputation caused by his sudden refusal and subsequent blocking of all communication.
