Yes, you can re-file the complaint if the other party fails to return your money within the promised 15 days. Since your original complaint was withdrawn based on their assurance, you can take the following steps: 1. Re-lodge a Police Complaint Go to the same police station and file a fresh complaint, mentioning: The original fraud. The false assurance given by their lawyer. The failure to return the money within the agreed time. Attach any written proof of their assurance (if available). 2. File a Private Criminal Complaint in Court (If Police Do Not Act) If the police refuse to register an FIR, file a private complaint under Section 200 CrPC in the Magistrate Court. Mention the job fraud details, their false promise, and the need for legal action. The court may direct the police to investigate and register an FIR. 3. File a Case for Cheating & Breach of Trust If fraud is involved, you can file under: Section 420 IPC (Cheating) Section 406 IPC (Criminal Breach of Trust) 4. File a Civil Suit for Recovery of Money If a large amount is involved, file a money recovery suit in a civil court. If they gave a written assurance, this can be used as evidence. Next Steps: Wait for 15 days (if still within the agreed time). If they fail to return the money, immediately file a fresh complaint. If police don’t act, file a criminal complaint in court. Would you like help in drafting a strong complaint for police or court?
