Is Physical attendance required for fixing schedule in trial court

30-Jul-2026 (In Criminal Law)
I'm facing trial in sessions Court for sections 313 IPC. Two months back, charges have been framed. Next hearing is for fixing schedule. Is it mandatory for accused to appear for that particular hearing of fixing of schedule or our engaged lawyer can manage it ??as I couldn't attend next hearing From last 2 hearings, judge is posting schedule fixing for next hearing and so on. Is that judge fix schedule next hearing or will it be again postponed. Any time limit fixed for that?

If the next date is only for fixing the trial schedule, your advocate can usually appear on your behalf if the court has not specifically directed your personal presence or if your exemption from appearance is granted. There is no fixed time limit for the Sessions Court to finalize the schedule, so the judge may fix it on the next date or adjourn it again depending on the court's workload. Consult your advocate and, if necessary, file an exemption application before the hearing.

Depends before which court your matter is listed, No problem if you do not appear you can always appear through an advocate you just need to file an exemption application judge will allow it it's on your advocate how he drafts your exemption application

yes as an accused and facing charges of a criminal act, you must have to mark your presence before the hon'ble court but for some exceptional cases you can also file an application for your non appearance through your legal counsel.
