only non payment of money can be civil matter not a criminal matter unless it has been in criminal breach of trust under IPC. you have not mentioned the transaction of money whether it has legally enforciable right.

Non payment of money is a serious offence and will fall under the ambit of Section 420 of Indian Penal Code,1860. It is cognizable and non-bailable offence. If the complaint is filed by you or against you the other person will have to apply for bail and can be arrested if proper measures are not taken
