Sir, a case was registered against my family member for providing a false affidavit while joining a government job in the education department. The case has been registered under IPC Sections 420, 467, 468, and 471. Are there any recent judgments related to punishment under these IPC sections?

Yes. The Supreme Court in Jupally Lakshmikantha Reddy v. State of Andhra Pradesh (10 Sep 2025) quashed Section 420/468/471 proceedings holding that cheating under Section 420 requires a false representation of a material fact that induced the victim to act and that forgery offences (Sections 468/471) require mens rea and proof of manufacturing/using a forged document [https://www.verdictum.in/court-updates/supreme-court/jupally-lakshmikantha-reddy-v-state-of-andhra-pradesh-2025-insc-1096-offence-cheating-false-representation-material-fact-1590974] ; High Courts have, however, continued to entertain FIRs in education-service contexts where false affidavits/forged appointment documents are alleged (see Tejbir Rathi & Anr. v. State of Haryana, Punjab & Haryana HC, 04 May 2022 [https://indiankanoon.org/doc/190014497/] and Bharat v. State of Maharashtra, Bombay HC, 03 Jan 2024 [https://www.legitquest.com/case/bharat-v-the-state-of-maharashtra-and-ors/7A0365]); the settled constitutional/administrative principle remains that an appointment obtained by fraud is void ab initio (S.P. Chengalvaraya Naidu v. Jagannath, (1994) 1 SCC 1). For statutory position note that the IPC provisions cited have been re'cast under the new penal and procedure statutes (Bharatiya Nyaya Sanhita, Bharatiya Nagarik Suraksha Sanhita and Bharatiya Sakshya Adhiniyam); see the BNS text and Gazette publication. Section 420 IPC-Cheating and Dishonestly Inducing Delivery of Property in India
Under Section 420 of the Indian Penal Code (IPC), the offense of cheating and dishonestly inducing someone to deliver property is punishable with imprisonment of up to seven years and a fine. This offense is cognizable and non-bailable, meaning the police can arrest the accused without a warrant, and the case can be tried by a First-Class Magistrate. Victims of financial fraud or cheating in India can file a complaint with the police to initiate legal proceedings under this section.

Sections 467, 468, and 471 of the Indian Penal Code (IPC) deal with serious offenses related to forgery. Section 467 pertains to the forgery of valuable securities, wills, or other important documents, and carries the harshest penalty imprisonment for life or up to ten years, along with a fine. Section 468 covers forgery intended for the purpose of cheating, punishable with up to seven years of imprisonment and a fine. Section 471 addresses the use of a forged document as genuine, with penalties of up to two years of imprisonment and/or a fine. These sections are often applied together in cases involving fraudulent documents.

Punishments Under IPC Sections 420, 467, 468, and 471

The Indian Penal Code (IPC) covers offenses related to cheating, forgery, and using fake documents under Sections 420, 467, 468, and 471. Below are the punishments and key court rulings:
  • Section 420 IPC: Cheating and dishonestly inducing delivery of property
    • Punishment: Up to 7 years imprisonment + fine
    • Judgment: Mahadeo Prasad v. State of West Bengal (AIR 1954 SC 724): The Supreme Court held that fraudulent intent at the time of inducement is necessary to establish an offense under this section.
  • Section 467 IPC (धारा 467 आईपीसी): Forgery of valuable security, will, etc.
    • Punishment: Life imprisonment OR up to 10 years + fine
    • Judgment: Raghoonundan Puttrounvees (1871) 15 WR (Cr) 19—The court ruled that even an unregistered document can be considered valuable security under this section.
  • Section 468 IPC (धारा 468 आईपीसी): Forgery for the purpose of cheating
    • Punishment: Up to 7 years imprisonment + fine
    • Judgment: Jagan Nath (1926) 28 Cr LJ 461 – The court clarified that actual cheating is not necessary; the intention to cheat is sufficient to attract charges under IPC 468.
  • Section 471 IPC (धारा 471 आईपीसी) – Using a forged document as genuine
    • Punishment: Up to 2 years imprisonment and/or fine
    • Judgment: Asstt. Sessions Judge v. Ramammal (1913) ILR 36 Mad 387: The court ruled that merely possessing a forged document is not an offence unless it is used as genuine.
Note: Courts may impose separate or cumulative punishments under IPC 467, 468, and 471 based on Section 31 CrPC.
