Intercourse under false promise of marriage (BNS 69)

A spa is running sex racket, my friend visited that spa 2 times. 20Oct & 10Nov. The lady took his number and she was texting him regularly and inviting him to spa center. Fed of this he blocked that lady's number on 27th January 2025. Its been 4.5 months since he visited that spa center. But now he is afraid of BNS 69. Although no arguments happened between my friend and that sex worker lady. He has the wtsapp chat & payment screenshot. Can that lady register FIR on BNS 69?

Since your friend has WhatsApp chats and payment proof, these could help demonstrate that there was no coercion or misconduct on his part. However, if he fears a false case, he should: 1. Avoid further contact with the woman or the spa. 2. Preserve all evidence, including chats and transactions.

if your friend promise her to marry with her in massage and on phone calls had if she hav screenshots of that's messages related to promise of marrige then she can make complaint against your friend but you have a remedy you can file a general complaint in your local police station for further enquiry you can consult with me Thank you Regard Sandeep Vats Advocate

Please ask your friend not to be afraid of any such thing because the lady cannot file an FIR on BNS 69. She will have to supply a lot of evidence against the said complaint which she might not be having at time of filing of FIR

If there was no wrongdoing or dispute between your friend and the lady, then the lady won't succeed. However, if he is worried, he should keep all records (WhatsApp chats, payments) as evidence. If any legal issue arises, he should consult a lawyer immediately.

Yes any girl/woman can register an FIR immaterial of the time period of the offences and the police may be glad to entertain the FIR registration. You should contact an advocate and discuss the complete matter and material available and if it turns out to be on your side your advocate may advise you and help you get an FIR filed against the blackmailers or atleast tell you a way out to protect your friend from any future risk created by the woman or her accomplices.
