If the insurance agent issued a fake policy document and there is no record of endorsement in the company's system, this amounts to fraud and forgery under Indian law. Here’s what you can do: File a Police Complaint (FIR): Report the fraud at your nearest police station under Sections 406 (Criminal Breach of Trust), 420 (Cheating), and 468 (Forgery) of the IPC. Attach copies of the fake policy, payment proof, and communication with the agent. Complain to the Insurance Company: Inform the insurance company about the fake policy. Legal Notice and Consumer Court Case: Send a legal notice to the agent demanding a resolution. If no action is taken, file a complaint in the Consumer Court for financial loss and mental harassment. Legal Actions You Can Take: 1. File a Police Complaint (FIR) under Sections 317, 325, and 329 of BNS. 2. Report the fraud to the Insurance Regulatory and Development Authority of India (IRDAI) via their Grievance Redressal Mechanism (IGMS) 3. File a Consumer Court Complaint under the Consumer Protection Act, 2019 for deficiency in service and compensation for mental harassment. 4. Approach the Insurance Ombudsman for quick redressal. You should retain all documents, including the fake printout, payment receipts, and communication with the agent, as proof for legal action.
