In how many days does court send summons to the accused.

After the charges are framed on accuse, does court issues summon to the complainant on its own to produce evidence, if yes then in how many days and between how many dates, is there any time limit. if no then what is the procedure. is it the job of my lawyer. also if complainant do not turn to court after issue of summon is there any relief for accuse, like quashing of case.

Hi your query is not well defined, wether you are talking about complaint case or case instituted after lodging of first information report. The procedure is completely different in both the cases please provide more details.

Hello,

If the court admits the case on the first date then usually the Summon is served upon the accused by the curt, now this is the duty of your lawyer to keep i touch with the staff of the Court and get the things done expeditiously. Also if the accused does not turn up on serving the summon the Court issues Bailable Warrant and subsequently non bailable warrant.

The accused always has a right to approach the High Court for getting the proceedings of the lower court quashed but such thing happens very rarely when the case in the lower court has been filed without any pith and substance.

Yes case/ complaint can be quashed if complainent have failed to appear in court after many reminder from court. Application can be move to quash the case depending also depends upon the severity of crime.lawyer can help in speeding the process of sending summon
