Impersonation with consent -my money used-on what grounds FIR be filed

26-Sep-2025 (In Criminal Law)
Prior to gaming act, My elder brother used my mother's PAN details to set up an online gaming (My11circle rummy) account, he also used her banking credentials to send money to gaming platform and has lost a lot of money online - it seems before he did that, he has taken a statement from my mother authorising him to set up a gaming account - my deposited money is also used -but she didn't know fallout - are both liable for crime - even if consent is given its considered illegal can FIR be filed?

hello, Even if your mother gave consent, using PAN and bank details for online gaming can attract criminal liability if it violates the Gaming Act or IT Act. Consent does not absolve illegality if the act itself is unlawful. Your brother may be liable for cheating, misusing credentials, or breach of trust under BNS/IT Act. If your mother was unaware of consequences, her liability is minimal, but she may be examined as a witness. Yes, an FIR can be filed, but liability will primarily fall on the person who misused the account.
