From the facts stated, multiple cognizable offences are clearly made out. The act of transferring ₹5 lakhs from your deceased father’s account to a personal account without authority amounts to offences such as cheating, criminal breach of trust, and possibly forgery/impersonation (especially if credentials were misused). Further, filing a complaint in the name of a deceased person to facilitate transfer of the car is a serious act indicating fabrication of records and giving false information. The police treating the complaint as “NC” appears improper since the allegations disclose cognizable offences requiring registration of an FIR. You may take the following steps: 1. Submit a written complaint to the Superintendent of Police under Section 173(3) BNSS (earlier 154(3) CrPC) seeking registration of FIR. 2. If no action is taken, file an application under Section 175(3) BNSS (earlier 156(3) CrPC) before the Jurisdictional Magistrate seeking direction to register FIR and investigate. 3. Alternatively, you can file a private complaint under Section 223 BNSS (earlier 200 CrPC). 4. Preserve all documentary evidence including bank statements, transaction details, and copies of the false complaint filed. Given the element of financial fraud and misuse of a deceased person’s identity, courts generally take such matters seriously. Immediate legal action is advisable to prevent further misuse of assets.
