“Regarding the process, process fee is generally payable for issuance/service of summons or other process, as directed by the concerned Court. Whether it can be paid/filed through e-Filing depends on the particular Court and case type. Regarding the affidavit, it should be prepared in the format prescribed/accepted by the concerned Court. Merely filing an affidavit on stamp paper and notarising it does not necessarily make it defective; however, if the Court has specifically directed a particular format or verification, that requirement should be followed.

In a private criminal complaint, once the Magistrate has passed an order for issuance of process/summons, the complainant is generally required to pay the prescribed process fee for service of summons on the accused. In Tamil Nadu, the Criminal Rules of Practice provide for payment of process fee, and the Court office will normally issue a notice indicating the amount payable and the time within which it has to be paid. The summons will be issued after the required process fee and other necessary papers are complied with. This is also consistent with Section 227 of the BNSS, 2023, relating to issue of process, and the general requirement that prescribed process fees be paid before process is issued.
