If a police officer misbehaves with you, there are several steps you can take to seek justice. First, document the incident thoroughly note the date, time, location, officer?s name or badge number (if known), and any witnesses. You can file a complaint with senior police officials, the Police Complaints Authority (PCA), or the State Human Rights Commission (SHRC). In cases involving serious misconduct or a cognizable offense, you can file an FIR, and if the police refuse, approach the Magistrate's Court for directions. In Delhi, complaints can also be submitted online through the Delhi Police or PCA portals. Always ensure you provide clear, factual details and, if available, supporting evidence.

Yes, there are remedies available for misbehaviour by police at the police station while filing an FIR. If a person feels that they have been subjected to any form of mistreatment, harassment, or abuse of power by police officers while filing an FIR, they can take the following legal steps: Approach a Senior police officer: If a person faces misbehaviour or mistreatment by the police officer while filing an FIR, they can immediately bring it to the attention of the Superintendent of Police of the concerned district who has the authority to take necessary action against the officer involved. In case the errant police officer refuses to lodge your FIR, you can always give it in writing to the same SP who is duty-bound to promptly take action on the same as per the mandate under Section 154(3), Code of Criminal Procedure, 1973. Document the incident: It is crucial to gather evidence to support the claim of misbehavior. If possible, you should try to document the incident by noting down the date, time, location, names of the officers involved, and a detailed account of what transpired. If there are any witnesses present, their statements can be valuable as well. File a complaint with the State Human Rights Commission: If you are still not satisfied with the response received from the police authorities, they can file a complaint with the State Human Rights Commission (SHRC). The SHRC can conduct an inquiry and take necessary action against the errant police officers. Approach the court: If none of the above steps provides relief, you can approach the court by filing a writ petition under Article 226 of the Constitution of India. The court can order an investigation into the allegations and direct appropriate action against the errant police officers. One must bear in mind all that one can do if police misbehave but at the same time one must not forget that filing a false complaint against a police officer can lead to legal consequences. Therefore, it is essential to have credible evidence to support the allegations of misconduct.
