based on the facts provided, the wife has strong grounds to object to the father-in-law's claim that he was not involved or living separately. Here's what she can do: File a Detailed Objection/Affidavit before the court stating: The father-in-law was regularly visited by the couple. He was fully aware of his son's drug addiction, violence, and mental instability. He manipulated his son into considering a second marriage and supported harassment by the first wife. Despite living separately, he interfered in their marital life and supported the harassment. Present Supporting Evidence, such as: Call records, messages, or any communication showing regular contact. Witnesses (e.g., neighbors, relatives) confirming frequent visits and his awareness. Medical or police records of husband's violent behavior that were known to the father-in-law. Regarding Streedhan: If the court noted it is not mentioned, file an application under Section 27 of the Hindu Marriage Act or Section 12 of the Protection of Women from Domestic Violence Act specifically detailing the streedhan articles and seek their return. Timely legal action with clear evidence will strengthen the wife's case and weaken false claims made by the father-in-law.

Well, in order to oppose Application of your Father in Law, you need to challenge it by filing a Counter Application or Objection Petition to his Application, then, by doing such, if you win, you can get Streedhan!

His drug addiction can be considered a ground for divorce, and depending on the situation, you can also file criminal or civil cases to protect yourself. ✅ Legal Options if Husband is a Drug Addict 1. ⚖️ Divorce on the Ground of Mental Disorder or Cruelty Under the Hindu Marriage Act, 1955, you can file for divorce on the following grounds: Cruelty (Section 13(1)(ia)) – If his addiction leads to abuse, threats, or unsafe behavior. **Incurable mental disorder
